Mark J. Linderman

Executive Summary

Mark Linderman co-chairs both the firm's Government Contracts and Construction Practice Groups. He is also a member of the Complex Commercial Litigation Practice Group.

Professional Qualifications 

With years of experience in complex commercial litigation, Mr. Linderman has extensive experience in federal, state and local procurement matters. He represents clients in contract negotiations, preparing and negotiating contract claims, bid protests, contract terminations, civil and criminal fraud investigations, litigation, and arbitration (including international ICC arbitration). In addition, Mr. Linderman advises clients on regulatory and accounting compliance. These clients range from major high-tech, energy, health care and defense contractors to multinational engineering and construction firms. Mr. Linderman has been recognized by Who’s Who Legal for his work in Government Contracts law.

Before joining Rogers Joseph O’Donnell, Mr. Linderman was a litigation partner at Sonnenschein Nath & Rosenthal LLP and SNR Denton LLP and chair of the firm’s government contracts practice. He also served as law clerk to the Honorable Aldon J. Anderson, United States District Court, District of Utah.

Mr. Mark Linderman is admitted to the Bars of the State of California and the District of Columbia. He is a member of the American Bar Association Section of Public Contract Law and a member of the committee on Health Care Contracting.

Selected Representations

  • Lead counsel in high-profile litigation against the Department of Energy and the National Nuclear Security Administration involving claims related to the construction and termination of the Mixed Oxide (MOX) Fuel Fabrication Facility, which was intended to transform nuclear weapons materials into nuclear fuel. CB&I AREVA MOX SERVICES LLC v. United States of America, Nos. 16-950C, 17‑2017C, 18-80C, 18-522C, 18-677C, 18-691C, 18-710C (consolidated) (Fed. Cl.). The consolidated litigation and related matters ultimately settled for $186 million.
  • Claims related to the construction of the V.C. Summer and Vogtle nuclear power plants.
  • Representation of a leading international software company in response to multiple “cure notices” received from the States of California and Mississippi on major IT implementation projects
  • Representation of an international engineering firm (including litigation/arbitration) in connection with several projects, including the Central Artery in Boston, the San Francisco Airport, the Golden Gate Bridge, the San Francisco Oakland Bay Bridge, Highway US 20 project in Oregon, the Bay Area Rapid Transit (BART) extension and the Jamuna River Bridge in Bangladesh
  • Claims arising from contracts to develop and manufacture propulsion equipment for the United States Navy’s “Seawolf” and “Los Angeles” class nuclear attack submarines
  • Litigation to enforce a contract to manufacture and construct a computer monitoring and control system for the City and County of San Francisco Water System
  • Extensive experience with terminations for default and convenience and related claims and litigation on a wide variety of programs including missile defense, logistics and provisioning, military aircraft including the A-12 stealth attack aircraft and navy submarines.
  • Representation of a major international heavy civil construction contractor in connection with contract acquisition, compliance claims and litigation including tunneling contracts terminated as part of the cancellation of the Department of Energy’s Superconducting Super Collider, the Toronto metro LRT, HART LRT, etc.
  • Significant experience with federal, state and local bid protests including contracts for weapon and computer systems and large infrastructure projects
  • Litigation of two significant and well-publicized patent infringement cases in the Northern District of California, related to endovascular grafts – medical devices used in treating vascular disease
  • Antitrust litigation between Sun Microsystems and Microsoft resulting in a settlement of over $2 billion for our client
