Whitney Miner is a member of the firm’s Complex Commercial Litigation, Retail Industry Trade Regulation, Environmental Law, and Cybersecurity and Privacy practice groups.

Professional Qualifications

A seasoned litigator and committed advocate, Ms. Miner focuses her practice on the defense of consumer class actions and complex commercial litigation, including business competition, false advertising, Consumer Legal Remedies Act, contract disputes and privacy matters. Ms. Miner also handles Americans with Disabilities Act and Unruh Act violation claims, including web access matters and environmental matters such as Comprehensive Environmental Response, Compensation, and Liability Act, California Environmental Quality Act and Proposition 65. 

She also regularly counsels clients in the food, cosmetics, retail and technology industries, and assists clients in all stages of growth in developing strategies to protect and enforce their global intellectual property rights – including implementing business-focused strategies to clearing, prosecuting, licensing and protecting trademarks and copyrights throughout their lifecycles.  

Some of Ms. Miner’s notable representations include: 

  • Representing a train control systems subcontractor in a $100 million+ breach of contract and business torts action in pre-trial proceedings and a 3-month bench trial.  
  • Representing a national disaster relief contractor in a breach of contract action that settled favorably on the eve of a jury trial. 
  • Representing a developer of WiFi power amplifier designs in a business tort and trade secret action that settled favorably. 
  • Representing a wine glass maker in a trademark infringement action. The case settled favorably on the eve of trial.

Before joining Rogers Joseph O’Donnell, Ms. Miner was an associate at a prominent litigation firm in San Francisco, where she successfully represented clients in various industries, including wireless communications, e-commerce, consumer goods and retail.

Ms. Miner is an active member of the Queen’s Bench Bar Association, the San Francisco Bar Association and the California Lawyers for the Arts, where she represents individuals on a pro bono basis. She also serves on the firm’s marketing committee. Ms. Miner was selected for inclusion as a Northern California Super Lawyers “Rising Star” from 2017 – 2023.
