Lisa N. Himes Weighs In On Tyson Foods’ Eighth Circuit Appeal

Tyson Foods has appealed a district court ruling remanding a pair of wrongful death actions to state court.  The suits allege that Tyson failed to implement proper COVID-19 safety measures at its facility, which resulted in four employee deaths.  In its Eighth Circuit brief, Tyson argues that it was acting under the direction of a federal officer, and as such, the cases belong in federal court.
