Today, Law360 published remarks by Lucas Hanback on President Trump’s new Executive Order 13950 on diversity training. In particular, Lucas’ comments focus on the effect of recent guidance which indicates that the Office of Federal Contract Compliance Programs is already fielding complaints that the training targeted by the order may be a violation of preexisting E.O. 11246, which prohibits discrimination by federal contractors. That is potentially significant because it indicates that even if the President is not reelected in November and E.O. 13950 is repealed, enforcement against the targeted “divisive concepts” may continue under E.O. 11246.
